One issue that has arisen is whether or not the federal government has the power to prosecute Internet gambling. This issue is based on the Commerce Clause and the Due Process Clause.

Section 1956 of the U.S. Code creates several distinct crimes related to Internet gambling. These include laundering to conceal, to disguise, to evade taxes, to promote illicit activity, and to avoid law enforcement stings.

These statutes are used in an effort to punish Internet gambling operators. Some of the prosecutions have included the United States v. K23 Group Financial Services.

In a recent case, Sporting News agreed to pay a $4.2 million fine. It was also required to launch a $3 million public-service campaign.
